Types of Cases We Do Not Handle
Representation Of Parties Other Than Tribes On Indian Child Welfare Act
When a tribe intervenes in an Indian Child Welfare Act (ICWA) case, the tribe has the right to counsel like parents and minor children. Under ICWA, tribes have special privileges to ensure protection of Indian children and the preservation of tribal communities.
CILS represents tribes on ICWA matters to assist tribes with using their voice to have a say in the courtroom and the outcome of dependent Indian children. CILS is unable to represent parents in ICWA cases as it would create a conflict of interest with the tribes we work with.
If CILS were to represent tribes and parents in ICWA matters, a conflict of interest would be created which would risk CILS being removed from the case and unable to assist with ICWA matters.
Criminal
CILS receives a majority of its funding from the Legal Services Corporation (LSC), which is a non-profit corporation publicly funded by the federal government to provide civil legal services for low-income individuals. Under LSC regulations, their funding is prohibited from being used to provide legal assistance on criminal matters. For that reason, CILS is unable to represent individuals on criminal law matters.
If you have been charged with a crime, CILS recommends that you speak with your court appointed counsel (otherwise known as a public defender), or seek out a private criminal law attorney.
