What is Expungement?

An expungement allows a defendant to withdraw a plea of guilty or no contest, enter a plea of not guilty and have the case dismissed. With an expungement, it is possible for both felonies and misdemeanors to be expunged, however, only some felonies can only be reduced to misdemeanors. Some expungements are discretionary, such as an interest of justice, while others are mandatory and can be contingent on other factors like the successful completion of probation.
